Building Codes

Temporary buildings, such as sheds, portables, trailers, motor vehicle bodies, etc. can only be used for short-term or transient operations on Port property. For long-term usage, Port Authority regulations require permanent structures that comply with the current edition of the Florida Building Code, including the Life Safety Code and the Florida Fire Prevention Code. In addition to the Florida Building Code, there are other state and federal regulations that impact the design and construction of buildings and structures within Port Canaveral.

The Florida Department of Environmental Protection (FDEP) sets and enforces state regulations for drinking water, wastewater, storm water and wetland development. You must submit proof of any required FDEP permits. Visit FDEP's Water Home page online or call 850-245-8335 for information on their regulations and for permitting forms.
The National Pollutant Discharge Elimination System (NPDES) program outlines federal requirements for storm water treatment and permitting, based on tenants' SIC (Standard Industrial Code) numbers. The Canaveral Port Authority also has developed standards and guidelines for CPA and tenant improvements. This is to ensure that all development at the Port, from its earliest planning and design stages, is aligned with our goals for safety, resource management, environmental quality and economic development.

The 2002 Port Canaveral Land Use Plan sets goals for development within the Port, including uses, amenities and the general character of key areas.

CPA Site and Design Guidelines are a tool for implementation of the Land Use Plan. They establish a shared vision of the character and quality of development within the Port, so that each tenant's improvements will enhance the value of Port Canaveral and other investments within it. These guidelines apply to new projects and substantial alterations in four land-use planning areas: the Marina Area, the Mullet Road/ Scallop Drive Area, the Canaveral Cove Phase II Area, and the Columbia Road Area. The guidelines cover site elements such as parking, landscaping and lighting plus building design issues that include size, general character, color and materials.

CPA Flood Damage Protection Regulations were developed to help minimize public and private losses due to flood conditions in certain areas of the Port. Potential losses include loss of life and property, health and safety hazards, prolonged business disruptions, damage to public facilities (streets, bridges, etc.) and utilities (water, gas, electric, telephone, sewer), and public expenses for flood control and relief and rescue efforts. Eliminating obstructions in floodplains and adequately protecting structures in flood hazard areas benefit the entire community.

The CPA Light Management Plan addresses and strikes a balance between the twin issues of Port security requirements and protection of our endangered sea turtles. It sets guidelines for outdoor lighting that impacts beach areas where turtle nesting occurs.

The Port's code enforcement officers investigate complaints regarding violations to any of these codes and policies. Their job is to investigate possible violations, contact violators and work with them to resolve the problem. Violators are given a reasonable time to correct violations. If a violation remains unresolved, officers can issue a citation with civil penalties in the form of fines (enforceable through liens) or a notice to appear at a county court hearing.
