How to Apply for a New Lease
or an Extension or Modification to Your Lease
Our prospective and existing tenants deserve fair and equitable treatment in regard to lease application requests and this process was created to help us ensure that they receive it.
Whether you're applying for a new lease or an extension of or modification of an existing lease, the first step is to submit your request in writing to the Tenant Relations Department. Please make sure you include the proposed length of the lease and the proposed usage. You may be required to furnish a current survey of the property, on request of the Tenant Relations Department.
Extensions. A written request for an extension to an existing lease should be made to the CPA at least six months before the lease runs out. When considering extensions, the Commission takes into account how compatible the lease and its usages are with the Port Canaveral Land Use Plan and any other land use and/or development plans adopted by the Commission.
Assignments. An Assignment of Lease will be considered if there is no change in usage or the new use is compatible with the Port Canaveral Land Use Plan, and if improvements on the property meet current building, fire and environmental codes.
Changes in Use. All Port leases contain a list of uses that are approved for the leased property. The Commission will consider a change in usage if the new use or uses are compatible with the Port Canaveral Land Use Plan and are in the best interests of the Port Authority.
When you submit your request for a lease or lease modification, you will be asked to pay a processing fee which varies with the purpose of your request.(See Lease Application Fees.) This fee will be refunded if your application is not approved.
If your application is reviewed favorably by the Port Chief Executive Officer, it will be put on the agenda of a regular meeting of the Canaveral Port Authority Commission. We encourage you to appear in person at the Commission meeting during which your lease application will be considered. Although no applicant or lessee is considered to have an automatic right to a lease or to an extension or modification of an existing lease, careful consideration is given to each application by the Commission and every attempt is made to reach a timely decision.
Note: A right of refusal in favor of the Canaveral Port Authority will be included in all new or modified bulkhead or "Transitional Area" leases. "Transitional Area" is as defined in the Port Canaveral Land Use Plan Table 3 and includes the marine/industrial, commercial fishing and commercial-industrial/mixed-use lands located west of Dave Nisbet Drive and east of Cape Marina, bordered by Mullet Road to the south and, to the north, including all leases bordering Scallop Drive.
